i believe its cus i don't appear in the video. Is that a strict rule that i must appear in the content?
The requester gave me the files with a fantasy in mind. My voice covers the entire 17 mins of the video. Technically my voice is in the video and also a ton of cartoon figures.
Im at a dilemma here:
How am i supposed to get the Legal Docs of 100s of Models in a compilation video? most of which left the business years ago? How can i use fictional characters then?
Kinda unfair, others with MY content can use it until i manage to find it and only delete it if a DMCA is filed and is successful, but i have to drop my best tools beforehand... We all lose earnings in the long run.
I get payed per min. A simple retouch and Voice Over gets well payed in my niches since everything is custom fantasies. with the condition that its uploaded to a Tube to give free access to our fetish community. Compilations and Amateur Tags from PH are exactly for this kind of content.

i need to be creative, focus specifically on the desires of my audience and spread my brands awareness. Having content properly watermarked is the best Organic Direct Traffic there is.
Until i have earned enough for a professional production i will have to keep doing these small tasks.

I mean, i know im weird and everyone is avoiding me... but i have no intention of cheating or doing something illegal and so many others do it anyways. I just want to earn my share with the tools i have the best way i can by doing something i and so many others really enjoy.

If you don't have the model releases & 2257 on all the people in those vid then you can NOT use it.
We all want to make money, but your tools does NOT including other's copyrighted work. You need to read up on 2257 because it is the law and amateur or not the U.S. gov does not care.
Create content with you in the video.

Of course im not going to use without the creators permission. Getting all the Documents is the issue...
And yes i use my own content!
Issue i have is that most time i cant contact the owners or since they where amateurs to start with. Profiles gone, contact info wrong or wont ever answere since they dont even care for the files anymore.

Isnt Disney the owner of the characters? How come anyone can use them? Isnt it against the DMCA?

I think the simple answer to that is you can publish content that you appear in alone without any additional documentation, anyone else that appears in your content has to be added as a "guest model" and you must have their identification on file with a model release and 2257 on file.
You can create content that you do not appear in provided that you have the identifications and model release and you add the model as a guest as well.

The new SynC says that "ONE SHOULD BE PRESENT" not must be.
What if i only make the voice over but use a created character from someone else.

Stuff made in a computer that have a licence but no real human.
There is so much more kinds of porn not involving any humans.

__You can only use content which you own the copyright to, or has a public domain license. If you use other content, you are stealing.
__You yourself are required to have a 2257 for every scene you appear in, even if you are also the producer. Most people don't do this, but only because they can document themselves any time as they are the only one who could claim against it.
__All paperwork must be signed prior to filming.
__Most cartoon/book/comic/movie characters are trademarked. Do not use these in any production. Make your own parody version instead.
__You can find lawyers who specialize in adult at a lot of conventions. I reccoment sitting in on a seminar.
Hey Brandynette to all the solid points that ladies has already mentioned in this thread I can also address question why you need to be present in the content you are sending:
- Right now SynC only got 1 partner connected - Pornhub. Moreover, the program that you are joining with Pornhub called 'Model Program' and it's created for performers to be able to promote their personal sites and monetize their content.
So as much as we have a lot of:
- Content Producers
- Studios
- License owners
etc etc
Only individual models with the videos where they are present are allowed to be a part of Pornhub's Model Program. When we will have more integrations (and we are working on this right now) - I'm sure some partners will be allowing various types of content. Yet, as all the beautiful ladies stated - you need to have all the legal docs, rights, statements, etc.

There are copyrights & trademarks, just because you found it on google doesn't give you any of the rights to it.
Those drawings, art work, video game characters are all copyrighted & trademarked.
The holders of those rights may not come after you immediately but eventually & sue you for damages. How much money are you going to make? Is it enough to cover a lawyer's fees & damages?
You can just create your own, I love cosplay but I don't copy any character. I create my own to avoid such problems.
